BICYCLE, E-BIKE, AND EQUIPMENT RENTAL

WAIVER AND RELEASE OF LIABILITY

I acknowledge that I am renting a bicycle, electric bicycle (“e-bike”), and/or related equipment or accessories from Back to Eden Bikes, LLC (“Company”) for recreational use. Equipment and accessories may include, but are not limited to, helmets, child seats, trailers, baskets, locks, lights, and other related items.

Assumption of Risk

I understand that bicycling and e-biking involve inherent risks, including but not limited to serious personal injury, permanent disability, paralysis, death, and property damage. These risks may arise from loss of control, falls, collisions with vehicles, pedestrians, other cyclists, or objects; road, sidewalk, or surface conditions; weather; equipment malfunction; rider inexperience; or the actions or negligence of others.

I knowingly and voluntarily assume all risks, whether known or unknown, associated with the rental, use, or operation of the bicycle, e-bike, and/or equipment.

Release of Liability

In consideration of being permitted to rent and use the bicycle, e-bike, and/or equipment, I, on behalf of myself, my heirs, assigns, and personal representatives, release, waive, discharge, and covenant not to sue Back to Eden Bikes, LLC, its owners, members, officers, employees, agents, and affiliates from any and all claims, demands, actions, or causes of action arising out of or related to my rental or use of the bicycle, e-bike, and/or equipment, including claims arising from the negligence of the Company, to the fullest extent permitted by law.

Helmet Use & Safety

I acknowledge that helmets are provided and that helmet use is strongly recommended and/or required by Back to Eden Bikes, LLC. I understand that failing to wear a helmet significantly increases the risk of serious injury or death. I agree to operate the bicycle, e-bike, and/or equipment in a safe and lawful manner and to comply with all applicable traffic laws and regulations.

Responsibility for Equipment

I agree that I am responsible for the proper use, care, and return of the bicycle, e-bike, and/or equipment during the rental period. I am responsible for any loss, theft, or damage to the bicycle, e-bike, and/or equipment that occurs during the rental period, regardless of fault.

Minors, Children’s Bikes, Seats & Trailers

If I am renting or permitting the use of a children’s bicycle, child seat, or trailer, I represent and warrant that: I am the parent or legal guardian of the minor rider, or have legal authority to act on their behalf. I accept full responsibility for the supervision, safety, and conduct of the minor. I assume all risks on behalf of the minor. I release and agree to indemnify Back to Eden Bikes, LLC from any claims, demands, or causes of action arising from the minor’s participation or use of the bicycle, e-bike, or equipment.

Indemnification

I agree to indemnify and hold harmless Back to Eden Bikes, LLC from any claims, damages, losses, liabilities, or expenses (including reasonable attorney’s fees) arising out of my rental, use, or misuse of the bicycle, e-bike, and/or equipment.

Duration of Waiver

I understand and agree that this waiver applies to all rentals made by me with Back to Eden Bikes, LLC during the current rental season or within twelve (12) months of the date signed, unless revoked in writing or replaced by an updated waiver.

Severability & Governing Law

This waiver is intended to be as broad and inclusive as permitted by the laws of the State of Florida. If any portion of this waiver is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

I agree that I am responsible for the proper use, care, and return of the bicycle, e-bike, and/or equipment during the rental period. I am responsible for any loss, theft, or damage to the bicycle, e-bike, and/or equipment that occurs during the rental period, regardless of fault.

If unchecked, helmet use is required.
